Terms & Conditions

Welcome to FRSHRS ("the Platform"), a student nightlife, deals, loyalty, and community discovery service operated by FRSHRS LTD ("we", "us", "our"). By accessing or using the Platform — whether as a student user or a business vendor — you agree to be bound by these Terms & Conditions ("Terms"). Please read them carefully before using the Platform.

If you do not agree with any part of these Terms, you must not use the Platform.

The Platform is intended for users who are 18 years of age or older. By using FRSHRS you confirm that you meet this age requirement. We reserve the right to suspend or terminate accounts where we have reason to believe this requirement is not met.

• Students register using a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must not share your account, redemption codes, loyalty stamps, NFC tap-links, or QR codes with others in a manner that abuses the deal or loyalty system.
• We may suspend or terminate your account if we detect fraudulent activity, abuse of deals, manipulation of loyalty programmes or society check-ins, or any other breach of these Terms.
• By optionally providing a WhatsApp phone number, you consent to receiving deal alerts and group messages via that number. You may remove it at any time in your profile settings.

• Vendors must register accurate and complete business information. FRSHRS LTD reserves the right to verify business details and to suspend listings where inaccurate information is provided.
• Deals, loyalty programmes, flash sales, menu items, and society cards listed on the Platform must be genuine, available, and accurately described. Misleading promotions may result in immediate removal.
• Vendors must not use the Flash Sale, messaging, or broadcast tools to send spam, unsolicited commercial messages unrelated to their listed business, or any content that violates applicable law.
• Subscription tiers and trial periods are subject to the commercial terms agreed at onboarding and as updated from time to time.
• Vendors are responsible for ensuring that any deals, loyalty rewards, society perks, or offers they publish comply with all applicable laws and regulations, including consumer protection and advertising standards.

• All deals are subject to availability and any additional terms set by the individual business.
• FRSHRS acts as a discovery and facilitation platform only and is not a party to any transaction between students and vendors.
• Redemption codes and NFC/QR check-in events are recorded and tied to your account. Abuse or manipulation of these systems is strictly prohibited.
• Flash sales and time-limited deals are subject to the dates and times specified by the vendor. We cannot guarantee deal availability.
• We reserve the right to remove any deal that violates our content policies, applicable law, or the rights of third parties.

• Loyalty stamps, points, and rewards are issued through NFC tags, QR codes, or vendor-side scanning. Each stamp or check-in event is permanently recorded on your account.
• Stamps and points have no monetary value and are non-transferable. They may only be redeemed for the specific reward stated by the vendor.
• Vendors reserve the right to modify or discontinue their loyalty programmes at any time. In the event of programme discontinuation, outstanding rewards will be honoured for a reasonable period as notified by the vendor.
• Attempting to artificially inflate stamp counts or exploit NFC/QR systems will result in immediate account suspension and may be reported to relevant authorities.

• Physical NFC tags and QR codes provided by vendors are programmed to trigger specific actions (loyalty stamps, deal redemptions, or society check-ins) when tapped or scanned by a logged-in student.
• Each tap or scan is recorded as a permanent event on your account, including the timestamp, venue, and action performed. You acknowledge and consent to this recording by using these features.
• You must be logged in to the FRSHRS app for NFC taps and QR scans to be attributed to your account. Tapping a tag without being logged in will redirect you to the login page.
• NFC tags and QR codes must not be tampered with, cloned, or reproduced. Vendors must not deploy NFC tags that link to content unrelated to their registered FRSHRS account.
• Weekly perk eligibility for society check-ins is determined by a 7-day cooldown enforced by the Platform. Circumventing this mechanism constitutes abuse.

• Society memberships are created and managed by participating vendors. Membership requires verification at the vendor's discretion.
• Your society membership card (digital wallet pass or in-app card) is personal and non-transferable. Sharing your QR code or wallet pass with others to fraudulently claim perks is prohibited.
• Vendors may suspend or remove your membership if they have reason to believe you have abused the society or its associated perks.
• Digital wallet passes (Apple Wallet / Google Wallet) are generated by the Platform on behalf of the vendor. Pass content reflects the vendor's branding and perk information at the time of generation.

• Students may create and join community spaces and groups to share deals, discuss local events, and communicate. You are responsible for all content you post.
• You must not post content that is illegal, abusive, defamatory, discriminatory, sexually explicit, or otherwise harmful or offensive.
• Group messages and community posts may be stored on our servers and are subject to our Privacy Policy. Do not post sensitive personal information in group chats.
• We reserve the right (but not the obligation) to moderate, remove, or restrict content or users who breach these rules, without prior notice.

• Where vendors offer table pre-ordering or deposit-based deal bookings, payments are processed by third-party payment providers (Stripe and/or Base44 Payments). FRSHRS LTD is not a party to the payment transaction.
• Payment amounts, refund policies, and cancellation terms are set by the individual vendor. You should review these before completing a payment.
• FRSHRS is not liable for any disputes arising from payments made to vendors through the Platform. Disputes should be raised directly with the vendor in the first instance.
• Order records including your name, email, items ordered, and payment reference are retained for up to 7 years in accordance with our Privacy Policy.

By using the Platform, you acknowledge that we collect and process personal data as described in our Privacy Policy, which forms part of these Terms. This includes, but is not limited to:

• Account registration data (name, email).
• Deal interaction history (views, saves, redemptions).
• Loyalty stamp and points activity.
• NFC tap and QR scan check-in records, including timestamps and venue identifiers.
• Society membership status and perk redemption history.
• Group messages and community posts.
• Order and payment references.
• Analytics and usage data for personalisation and platform improvement.

You have rights over your personal data under UK GDPR. Please see our Privacy Policy for full details.

All content on the Platform — including the FRSHRS name, logo, design, and software — is the property of FRSHRS LTD or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.

By submitting content (e.g. reviews, images, group messages) to the Platform, you grant FRSHRS LTD a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with operating the Platform.

To the maximum extent permitted by law, FRSHRS LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform or any deals, orders, payments, NFC/QR check-ins, loyalty programmes, or society memberships facilitated through it.

Our total liability to you for any claim arising from these Terms shall not exceed the greater of £50 or the fees you have paid to us in the three months preceding the claim.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation of the Platform, nor the accuracy of any deal, offer, or event listing.

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to update these Terms at any time. We will notify users of material changes via the Platform or email at least 14 days before they take effect. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
